Terms of Service
Terms governing the use of PropCheck property intelligence reports and tools.

1. Introduction
These Terms of Service ("Terms") govern your use of PropCheck.pt ("PropCheck", "the Platform"), a property intelligence platform operated by FAIRBANK ("FAIRBANK", "we", "us"). By accessing or using PropCheck, you agree to be bound by these Terms.
2. Service Description
PropCheck is a property intelligence platform that cross-references data from Portuguese government registries — including the IRN (land registry), AT (tax authority), ADENE (energy agency), and Câmara Municipal (municipal council) — to generate property risk assessments for buyers and investors.
PropCheck offers the following services:
- Bureaucracy Scanner (free): IMI rate lookup, AL zone detection, EPC class preview — no login required.
- Essential Report (€299 per property): Complete four-document verification, Reality Gap Score, AIRCS assessment, AICF true-cost model — delivered in 72 hours, in English.
- Institutional (from €4,500): Portfolio-level intelligence, Predictive Sourcing engine, API access, white-label reports.

PropCheck is not a law firm. PropCheck reports are property intelligence documents. They do not constitute legal advice, legal opinion, or a substitute for independent legal due diligence. PropCheck does not replace a qualified Portuguese property lawyer (advogado or solicitador). For CPCV review, legal transaction management, and complex cases, PropCheck recommends engaging an independent Portuguese property lawyer.
4. PropCheck Reports
4.1 Report Accuracy
PropCheck reports are generated from data obtained from Portuguese government registries and public data sources. While we take reasonable care to ensure accuracy, we do not guarantee that government registry data is complete, current, or error-free. PropCheck reports reflect the data available at the time of generation.
4.2 Scoring Methodology
PropCheck's proprietary scoring systems — the Reality Gap Score, AIRCS (Asset Integrity and Regulatory Compliance Score), and AICF (Asset Integrity Correction Factor) — are analytical models based on document cross-referencing and publicly available data. Scores are indicative assessments, not guarantees of property condition or value.
4.3 Physical Inspection
PropCheck is a document intelligence platform. PropCheck does not carry out physical property inspections. Where the Reality Gap Score indicates significant divergence (score above 6), PropCheck recommends a physical inspection by a qualified inspection company before proceeding with a transaction.
5. User Obligations
By using PropCheck, you agree to:
- Provide accurate information when requesting reports.
- Not rely solely on PropCheck reports for property purchase decisions — always engage independent legal and professional advice.
- Not reproduce, redistribute, or commercially exploit PropCheck report content without written permission.
- Comply with all applicable laws when using PropCheck tools and data.
6. Payment and Refunds
Essential Reports are charged at €299 per property. Payment is required before report generation begins. Reports are delivered within 72 hours of payment confirmation. If we are unable to generate a report for the requested property (e.g., insufficient registry data available), a full refund will be issued within 14 business days.
7. Intellectual Property
All content, scoring methodologies, proprietary concepts (including Reality Gap Score, AIRCS, AICF, Brown Discount, Green Premium), tools, and software on PropCheck.pt are the intellectual property of FAIRBANK. You may not copy, modify, distribute, or create derivative works without written permission.
8. Limitation of Liability
To the maximum extent permitted by Portuguese law, FAIRBANK and PropCheck shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of PropCheck reports or tools, including but not limited to financial losses from property transactions. Our total liability for any claim shall not exceed the amount paid for the specific report giving rise to the claim.
9. Governing Law
These Terms are governed by and construed in accordance with Portuguese law. Any disputes shall be submitted to the courts of Lisbon, Portugal.
10. Changes to These Terms
We may update these Terms to reflect changes in our services or legal requirements. Material changes will be communicated to registered users via email and posted on this page with an updated date. Continued use of PropCheck after changes constitutes acceptance of the revised Terms.
